CRUCIBLE OF ASCENSION - QUICK TERMS
Before you enter Thaledria, here's what you need to know:
The Essentials:
✓ You must be 13+ years old (with parent/guardian permission if under 18)
✓ We own the game - you get a license to play for personal use
✓ Cards, Heroes, and Crystals are licensed, not owned by you
✓ We can balance cards/heroes anytime for game health
✓ No refunds on virtual items (unless required by law)
✓ Cheating, hacking, or harassment = account ban
✓ Disputes go to arbitration (not court) for US/Canada users
✓ We're not liable for service interruptions or progress loss
Your Account:
Secure it - you're responsible for everything that happens
Don't share, sell, or trade accounts
Inactive accounts (6+ months) may be deleted
Guest accounts can't transfer progress between devices
Purchases:
All sales are final
Virtual items can be modified or removed for game balance
Prices may change at any time
Behavior Rules:
Play fair - no cheats, bots, hacks, or exploits
Be respectful - no harassment, hate speech, or threats
No real-money trading of accounts or items
No stream sniping or other competitive exploitation
Important: These are highlights. By playing, you agree to the Full Terms of Service below.
FULL TERMS OF SERVICE
BINDING AGREEMENT NOTICE: These Terms form a legally binding agreement. If you don't agree, don't play the game.
ARBITRATION NOTICE: US and Canadian users agree to resolve disputes through binding arbitration, not court, and waive class action rights. See Section 9 for details.
TABLE OF CONTENTS
1. AGREEMENT AND CHANGES
1.1 Who We Are
Crucible of Ascension (the "Game") is provided by Do Not Disturb Games ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Game, mobile application, websites, and related services (collectively, the "Services").
1.2 Age Requirements
The Services are only for users 13 years and older. If you're under the legal age to enter a contract in your jurisdiction, your parent or legal guardian must consent to these Terms. Parents/guardians are responsible for minors' use of the Services.
1.3 Acceptance
By accessing or using the Services, you accept these Terms. If you don't agree, stop using the Services immediately.
1.4 Changes to Terms
We may update these Terms at any time. We'll notify you of material changes via in-game notice, email, or on our website. Continued use after changes means you accept the updated Terms. The "Last Updated" date at the top reflects the current version.
2. ACCOUNTS AND ACCESS
2.1 Account Types
Standard Account: Create with email or link to third-party accounts (Google, Apple, Facebook, etc.).
Guest Account: Limited access without registration. Warning: Guest accounts cannot transfer progress, restore purchases, or recover data if you reinstall, change devices, or delete the game. We cannot recover guest account data.
We strongly recommend creating or linking a standard account to protect your progress.
2.2 Account Security
You're responsible for:
Keeping your password confidential
All activity on your account (even unauthorized use)
Logging out after each session
Immediately notifying us of security breaches
We're not liable for losses from unauthorized account access if you failed to keep your account secure.
2.3 Third-Party Accounts
We have no obligations related to your third-party accounts (Google, Apple, etc.). All issues with third-party accounts must be resolved with that provider.
2.4 Account Termination
By You: Contact us anytime to terminate your account.
By Us: We may suspend or terminate your account if:
You violate these Terms
Activities on your account harm the Services or other users
You infringe third-party rights
Required by law
Your account is inactive for 6+ months
Upon termination: You lose access to all Virtual Items, progress, and data. No refunds will be provided (except where required by law).
2.5 Multi-Factor Authentication
We may require multi-factor authentication to secure your account and the Services.
3. VIRTUAL ITEMS AND PURCHASES
3.1 What You're Buying
You may acquire virtual currency ("Rays Crystals" or “Suns” or "Game Currency"), Cards, Heroes, cosmetic items, Battle Pass access, or other virtual items ("Virtual Items") by:
Purchasing with real money
Earning through gameplay
Receiving as gifts
Critical: You're buying a revocable license to access Virtual Items, not ownership. Virtual Items have no monetary value and cannot be sold, traded, or redeemed for real money outside the Game.
3.2 Card and Hero Balance
We may modify Cards, Heroes, or Virtual Items anytime for game balance, bug fixes, or legal compliance. These changes may affect their power, desirability, or utility. No compensation or refunds will be provided for balance changes.
3.3 Payment and Pricing
Purchases are made through Apple App Store, Google Play, or authorized platforms. You agree to:
Provide accurate payment information
Pay all fees and taxes
Accept that we may change prices anytime (doesn't affect previous purchases)
3.4 Refund Policy
All sales are final. We don't provide refunds unless required by law. Follow Apple or Google's refund policies. We may (but aren't required to) assist with refund requests to these platforms.
Exceptions: See Section 10 for EU/EEA consumer withdrawal rights.
3.5 Virtual Item Management
We may modify, remove, or eliminate Virtual Items anytime with or without notice. We'll provide refunds or replacements only if we entirely retire recently-purchased items. We won't delete Game Currency without notice (unless your account is terminated).
3.6 No Real-World Value
Virtual Items cannot be:
Sold or traded outside the Game
Converted to real money
Transferred to other players (unless explicitly allowed in-game)
4. LICENSE AND OWNERSHIP
4.1 What We Own
We own everything: the Game, all code, characters, Cards, Heroes, artwork, stories, names, Thaledria lore, gameplay mechanics, and all Game Content. You own nothing - not your account, Cards, Heroes, or Virtual Items.
4.2 Your License
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial entertainment only. This license ends immediately if we terminate your account.
4.3 What You Cannot Do
You may not:
Copy, modify, or create derivative works from the Game
Reverse engineer, decompile, or extract source code
Sell, rent, or commercially exploit the Services
Use the Game for commercial purposes without written permission
Use our trademarks, logos, or branding without permission
4.4 User-Generated Content
If you create content using Game Content (gameplay videos, deck guides, fan art, etc.), you grant us an irrevocable, perpetual, worldwide, royalty-free license to use, modify, and distribute that content for any purpose, including marketing. You retain no control over how we use such content.
The Game Content within your creations remains our property. You cannot license your content to third parties or use it commercially without our written permission.
5. CODE OF CONDUCT
5.1 Basic Rules
You must:
Comply with all applicable laws
Treat other players and our staff respectfully
Play fairly and honestly
5.2 Prohibited Conduct
Cheating & Exploitation:
Using cheats, hacks, bots, or unauthorized third-party software
Exploiting bugs or glitches for unfair advantage
Using automated tools to interact with the Services
Modifying game files or memory
Stream sniping (using broadcasts to gain unfair advantage)
Account Violations:
Sharing, selling, or trading accounts
Using others' accounts without permission
Creating accounts with false information
Account boosting or rank manipulation
Economic Violations:
Real-money trading of accounts, Cards, or Heroes
Selling or buying Virtual Items outside the Game
Fraudulent purchases or chargebacks
Harassment & Abuse:
Harassment, threats, or stalking
Hate speech or discrimination based on race, gender, religion, etc.
Sexual content or solicitation
Impersonating others (including staff)
Doxxing (posting private information)
Disruptive Behavior:
Spamming chat or messages
Deliberately losing (win trading) for manipulation
Non-participation or rage quitting repeatedly
Intentionally disrupting others' gameplay
Content Violations:
Posting illegal, harmful, or offensive content
Infringing others' intellectual property
Distributing malware or viruses
Off-Platform Conduct: These rules apply when you create content about the Game (streams, videos, social media posts). We may penalize your account for violations during content creation, even if they didn't occur in-game.
Content Creator Restrictions: You may not promote or sponsor services that violate these Terms, including account boosting, account sales, or real-money trading services.
5.3 Enforcement
Violations may result in:
Warnings
Temporary bans (hours to weeks)
Permanent account termination
Hardware bans
Removal of content
Progress resets
Loss of all Virtual Items (no refunds)
We may take action with or without notice. Violations in one game may result in penalties across all our games.
5.4 Monitoring
We may monitor and record your communications (text and voice) using the Services. You have no expectation of privacy for in-game communications. By using the Services, you consent to this monitoring for security and enforcement purposes.
6. USER CONTENT
6.1 Your Responsibility
You're solely responsible for any content you create, upload, or transmit using the Services ("Your Content"), including messages, images, deck names, or character customizations.
6.2 License to Us
You grant us a worldwide, perpetual, irrevocable, royalty-free license to use, reproduce, modify, and distribute Your Content in any way, for any purpose, without compensation to you. This includes:
Using Your Content in marketing
Modifying or removing Your Content
Displaying Your Content to other users
6.3 Content Standards
Your Content must not:
Violate laws or third-party rights
Contain viruses or malicious code
Be offensive, defamatory, or inappropriate
Infringe intellectual property rights
We may remove any Content at any time without notice.
6.4 No Confidentiality
Don't submit ideas or suggestions you want to keep confidential. Anything you submit becomes ours to use freely without obligation or compensation.
7. UPDATES AND BETA
7.1 Game Updates
We may update the Game anytime, with or without notice. Updates may:
Require download and installation to continue playing
Change system requirements (you're responsible for necessary equipment)
Use background patching (automatic updates)
Affect Virtual Items, game balance, or features
7.2 Beta/Alpha Testing
Beta/Alpha versions are provided "as is" for testing purposes. Beta content:
May not work correctly or contain bugs
May be reset at any time (losing all progress)
Is used at your own risk
May collect additional data for improvement
We have no obligation to provide an official release after beta/Alpha testing. All Virtual Items obtained during beta may be deleted.
8. DISCLAIMERS AND LIABILITY
8.1 No Warranties
THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We don't guarantee:
Uninterrupted or error-free service
Accurate or reliable information
Defects will be corrected
Security from viruses or attacks
Cards, Heroes, or mechanics will remain unchanged
Some jurisdictions don't allow warranty disclaimers, so this may not fully apply to you.
8.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
We're not liable for:
Indirect, consequential, or punitive damages
Lost profits, data, or business opportunities
Service interruptions or terminations
Changes to Virtual Items or game balance
Unauthorized account access (if you didn't secure your account)
Our maximum liability is limited to the amount you paid us in the last 12 months.
Exception: We don't exclude liability for death/personal injury from negligence, fraud, or where law prohibits exclusion.
8.3 Your Device and Data
You're responsible for:
Your mobile data charges
Procuring necessary hardware/software
Maintaining internet connectivity
Device security
8.4 Third-Party Disputes
Disputes with other users or third parties are between you and them. You release us from all claims related to such disputes.
8.5 Force Majeure
We're not liable for delays or failures caused by events beyond our control, including natural disasters, war, terrorism, cyberattacks, pandemics, or government actions.
9. DISPUTE RESOLUTION
9.1 Who This Applies To
IF YOU LIVE IN:
United States or Canada → Sections 9.2-9.7 apply
European Economic Area → Section 10.2 applies
Elsewhere → Section 10.3 applies
9.2 Informal Resolution (US/Canada)
Before filing arbitration, you must:
Send written notice to coas@donotdisturbgames.com describing the dispute
Include your name, account info, and proposed resolution
Negotiate in good faith for 60 days
If we have a dispute with you, we'll send notice to your account email.
9.3 Binding Arbitration (US/Canada)
YOU AND WE AGREE TO RESOLVE DISPUTES THROUGH BINDING ARBITRATION, NOT COURT.
What is Arbitration?
Private dispute resolution by a neutral arbitrator
No jury trial
Limited discovery compared to court
Final and binding decision with limited appeal rights
Arbitration Details:
Administered by American Arbitration Association (AAA)
AAA Consumer Arbitration Rules apply
Single arbitrator decides all issues
Location: Your county of residence or virtual/telephone hearing
Each party pays own attorneys' fees (unless law requires otherwise)
Filing Fees:
If we initiate: We pay all fees
If you initiate: You pay initial filing fee per AAA rules (we may pay if excessive)
9.4 What Arbitration Covers
All disputes related to these Terms, the Services, your account, payments, or termination, EXCEPT:
Small claims court cases (if within jurisdiction)
Intellectual property infringement claims
Claims that cannot legally be arbitrated
9.5 No Class Actions
YOU CANNOT:
Bring class action lawsuits
Join class arbitrations
Act as class representative
Consolidate your claim with others
If this prohibition is found invalid, the entire arbitration agreement is void.
9.6 Mass Arbitration Process
If 25+ similar claims are filed ("Mass Arbitration"):
Bellwether Process: Only 10 selected test cases proceed to arbitration first
Each side selects 5 cases
Cases are tried to test arguments
Global Mediation: After bellwether cases conclude, all parties must mediate remaining claims
If mediation fails: Remaining claims may proceed to court (arbitration no longer applies)
This process may significantly delay your individual claim if it's part of Mass Arbitration.
9.7 Opt-Out Right (US/Canada Only)
You have 30 days to opt out of arbitration.

Include your name, address, and account information. If you opt out, you can bring claims in court (subject to Section 9.5 class action waiver).
10. REGIONAL PROVISIONS
10.1 European Economic Area (EEA) and United Kingdom
Governing Law: Irish law (subject to your local consumer protection laws)
Age Requirement: 16+ (instead of 13+)
Withdrawal Rights: As an EU consumer, you have a 14-day withdrawal right for purchases. However:
Virtual Items are delivered immediately upon purchase
By purchasing, you explicitly consent to immediate delivery
You forfeit your withdrawal right upon delivery
To exercise withdrawal (before delivery): Email: coas@donotdisturbgames.com within 14 days of purchase.
Account Termination: We must provide advance notice before terminating your account (unless you seriously breach Terms or law requires immediate action).
Service Discontinuation: We'll provide 30 days' notice before discontinuing Services (unless required by law to act immediately).
Refunds on Termination: If we terminate for convenience (not your breach), we'll refund unused Virtual Items.
Alternative Dispute Resolution: You may use the EU Online Dispute Resolution Platform.
Translation: If any conflict exists between English and translated versions, your local language version prevails.
10.2 Other Regions
Governing Law: Israeli law
Jurisdiction: Courts in Tel Aviv, Israel
No Arbitration Requirement: Disputes proceed directly to court
11. GENERAL TERMS
11.1 Apple App Store Terms
These Terms are between you and us - Apple is not a party. Apple:
Is not responsible for the Game or support
May refund purchase price if Game doesn't conform to warranty
Is not liable for any claims related to the Game
Is not responsible for intellectual property claims
You represent you're not in a US-embargoed country or on restricted party lists.
Apple and subsidiaries are third-party beneficiaries and can enforce these Terms against you.
11.2 Google Play Terms
To the extent of conflict between Google Play Terms and these Terms, Google Play Terms control for your use via Google Play.
Google has no responsibility for compliance or non-compliance with these Terms.
11.3 Entire Agreement
These Terms (including policies referenced) constitute the complete agreement between you and us, superseding all prior agreements.
11.4 Assignment
We may assign these Terms to any party anytime. You cannot assign these Terms without our written consent.
11.5 Severability
If any provision is found invalid, it will be severed and the remaining Terms continue in effect.
11.6 No Waiver
Our failure to enforce any provision doesn't waive our right to enforce it later.
11.7 Export Controls
You may not use the Services if:
You're on US restricted party lists
You're in embargoed countries (Cuba, Iran, North Korea, Syria, etc.)
It would violate export controls or sanctions
11.8 Survival
Sections 3 (no refunds), 4 (ownership), 8 (disclaimers), 9-10 (dispute resolution), and 11 survive termination of these Terms.

APPENDIX A: STANDARD LEGAL PROVISIONS
Notices: All legal notices must be in writing to the addresses in Section 11.9. We may provide notices via email, in-game notifications, or on our website.
Equitable Remedies: Breach of intellectual property provisions may cause irreparable harm. We may seek injunctive relief without posting bond.
Headings: Section headings are for convenience only and have no legal effect.
Duration: These Terms begin when you first accept them and continue until terminated. Certain provisions survive termination as specified.
Interpretation: "Including" means "including without limitation." References to "days" mean calendar days.
APPENDIX B: KEY DEFINITIONS
Game Content: All aspects of the Services including code, graphics, characters, Cards, Heroes, stories, and game mechanics.
Services: The Game, mobile app, websites, and all related services provided by Do Not Disturb Games.
Virtual Items: Game Currency (Suns, Ray Crystals), Cards, Heroes, cosmetic items, Battle Pass access, and other virtual content.
Terms: These Terms of Service, including all referenced policies.
You/User: The individual accessing or using the Services.
BY CLICKING "ACCEPT" OR BY ACCESSING/USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS.
